The Intra Corporate Transferee (ICT) directive applies to managers, specialists and trainees and implies that, provided they meet certain conditions, managers and specialists from outside the EU can be transferred to companies within the Netherlands for a maximum of three years. Trainees can be transferred for one year. A benefit of the new rule is that the employees also have flexibility to work temporarily in other member states, excluding Denmark, the UK and Ireland.
Overriding other schemes
It is important to note that this group of employees is no longer eligible for the highly skilled migrant scheme. Applications will have to be made on the grounds of the new rule, which replaces all other application types. Any applications for highly skilled migrant status will be checked against the conditions of the ICT directive, and in the case of an overlap, only an ICT permit will be granted.
